2 Purpose of the Legal Notice

This Legal Notice regulates the access, browsing, and use of the DogEpiMonitor application, as well as the responsibilities derived from its use. Accessing the application attributes the status of User and implies full and unreserved acceptance of all provisions included in this Legal Notice, the Terms and Conditions of Use, and the Privacy Policy in force at the time of access.

3 Nature of the Information

The information contained in DogEpiMonitor, including texts, graphics, images, icons, technology, software, links, and other contents, is provided solely for informational and organizational purposes. The application works as a personal tracking and recording tool that does not in any way substitute professional veterinary consultation, diagnosis, treatment, or advice.

DogEpiMonitor is not a medical device, is not certified as a health product, and should not be used to make medical decisions without first consulting a properly licensed professional veterinarian. The interpretation and application of the registered information is the sole responsibility of the User and their trusted professional veterinarian.

5 Intellectual and Industrial Property

All contents of the DogEpiMonitor application, including but not limited to texts, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, source code, object code, designs, navigation structure, and the application as a whole, are the exclusive property of the Owner or its licensors, and are protected by Argentine and international intellectual and industrial property laws.

The trademarks, trade names, distinctive signs, and other industrial property elements displayed in the application are owned by the Owner or, where applicable, by third parties who have authorized their use. Any reproduction, distribution, or public communication without the prior and express authorization of the rights holder is expressly prohibited.

The User obtains only a limited, personal, non-transferable, non-exclusive, and revocable license to access and use the application in accordance with the established Terms and Conditions, without this being understood under any circumstances as a transfer of any intellectual or industrial property rights.

6 Prohibition of Improper Use

It is expressly prohibited to: copy, reproduce, distribute, modify, decompile, reverse engineer, disassemble, or create derivative works of the application; use the application for illegal, unlawful, defamatory, obscene, offensive, or discriminatory purposes; transmit viruses, malware, or malicious code; attempt to gain unauthorized access to systems, servers, or data; impersonate another user; conduct unauthorized commercial activities; extract data using web scraping or crawling techniques; and any other use that violates current legislation or these legal terms.

7 Exclusion of Warranties

The application is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement of third-party rights, absence of errors, continuous availability, or specific results.

The Owner does not warrant that the application will operate uninterrupted, securely, or error-free; that defects will be corrected; that the application or the servers that host it will be free of viruses or other harmful components; or that the results obtained from using the application will be accurate or reliable.

8 Limitation of Liability

To the maximum extent permitted by applicable law, the Owner, its officers, employees, contractors, licensors, and suppliers will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, revenue, data, use, goodwill, or other intangible losses; business interruption; costs of procuring substitute goods or services; damages resulting from reliance on information obtained through the application; medical decisions made based on application information; errors, inaccuracies, or omissions in the content; unauthorized access to data or systems; or any other matter related to the use or inability to use the application.

This limitation will apply regardless of whether the Owner has been advised of the possibility of such damages, and even if a set remedy fails its essential purpose.

9 Indemnification

The User agrees to defend, indemnify, and hold harmless the Owner, its affiliates, officers, agents, employees, partners, and licensors from and against any claims, demands, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of: the User's use of the application; the User's violation of these terms or any law or third-party rights; the content the User submits, posts, or transmits through the application; or any negligent or willful misconduct by the User related to the use of the application.

10 Links to Third-Party Sites

The application may contain links to third-party websites, applications, or resources provided solely for the User's convenience. The Owner does not control, endorse, approve, or assume responsibility for the content, privacy policies, practices, or availability of such external resources.

Access to third-party sites is done at the User's sole responsibility, who must review the applicable policies and terms of each external site. The inclusion of any link does not imply endorsement, approval, or warranty by the Owner.

11 Force Majeure

The Owner will not be liable for any failure or delay in performing its obligations when such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, acts of terrorism, strikes or labor disputes, failures in telecommunication or internet services, power outages, legislative changes, government orders, pandemics, or any other cause of force majeure.

12 Dispute Resolution

Any dispute related to the use of the application, the interpretation or execution of these legal terms, or the relationship between the User and the Owner will be resolved first by direct good faith negotiation between the parties.

In the event that an amicable agreement cannot be reached, the parties may resort to voluntary mediation or arbitration before starting legal action, without this constituting a binding obligation.

13 Applicable Law and Jurisdiction

This Legal Notice, as well as the use of the DogEpiMonitor application, are governed entirely by the laws of the Argentine Republic. For the resolution of any dispute or conflict arising from the interpretation or application of this Legal Notice, as well as the use of the application, the parties expressly submit to the jurisdiction of the Ordinary Courts competent in the Autonomous City of Buenos Aires, Argentina, with express waiver of any other forum or jurisdiction that might correspond to them.

14 Severability

If any provision of this Legal Notice is declared null, invalid, or unenforceable by a competent court, such declaration will not affect the validity of the remaining provisions, which will remain in full force and effect. The invalid provision will be replaced by a valid one that fits as closely as possible the original intent.

15 Entire Agreement

This Legal Notice, together with the Terms and Conditions of Use and the Privacy Policy, constitute the entire agreement between the User and the Owner regarding the use of the DogEpiMonitor application, and supersede any prior agreements, negotiations, representations, or understandings, whether oral or written.
