Welcome to DogEpiMonitor. By accessing, downloading, or using this application, you expressly agree to be bound by these Terms and Conditions of Use. If you do not agree, you must refrain from using the application.
1. Definitions
"User" means any physical person using DogEpiMonitor; "Application" or "Service" means the software named DogEpiMonitor and all its features; "Owner" means the person responsible for the development and operation of DogEpiMonitor (Alejandro R. Di Russo); and "Pet" means the companion animal whose data is recorded in the application.
2. Purpose and Scope of the Service
DogEpiMonitor is a technological tool designed to assist pet owners in recording, organizing, and visualizing information related to epileptic episodes, medication administration, clinical progress, and medical history of their companion animals. The application facilitates the chronological tracking of events, enables the generation of informative reports, and provides data analysis features solely for organizational purposes.
It constitutes only an administrative and informative support tool and does not in any way replace professional veterinary judgment, specialized medical diagnosis, therapeutic treatment prescribed by a licensed professional, or the clinical tracking that must be performed by a registered veterinarian.
3. Medical Disclaimer
The User expressly acknowledges and accepts that all information generated, processed, stored, or displayed through the application is exclusively for informational, referential, and personal organization purposes.
DogEpiMonitor does not perform medical diagnoses of any kind; does not prescribe, suggest, or recommend treatments; does not interpret clinical results; and in no case replaces a professional veterinary consultation.
Decisions related to the health, well-being, medical treatment, and any other health determination regarding the Pet are the sole and non-delegable responsibility of the User in consultation with their trusted veterinarian. The Owner assumes no responsibility for medical decisions made by the User.
In the event of any medical emergency, change in the pet's health status, doubt about medication, appearance of new symptoms, or worsening of existing symptoms, the User must immediately consult a veterinarian. Delaying professional veterinary care can have serious consequences for the animal's health.
4. Artificial Intelligence Assistant
The application may include assistant features based on artificial intelligence to help the User organize information, generate reminders, or answer general questions about using the application.
The User expressly acknowledges and accepts that the AI assistant may make mistakes, provide inaccurate information, or generate responses that are not applicable to their pet's particular situation.
The assistant does not perform veterinary diagnoses, does not prescribe treatments, does not interpret clinical symptoms, and does not in any way replace a consultation with a professional veterinarian. The assistant must not be used in medical emergencies.
The User assumes full responsibility for any decision made based on information provided by the AI assistant. The Owner does not warrant the accuracy, reliability, or suitability of the answers generated and will not be liable for consequences resulting from their use.
5. Registration and User Accounts
To access certain features, the User must create an account. The User agrees to provide true, accurate, complete, and updated information, and is solely responsible for maintaining the confidentiality of their credentials and all activities occurring under their account.
The User must immediately notify any unauthorized use of their account. The Owner will not be liable for losses or damages arising from the User's failure to comply with security obligations.
6. Service Plans and Subscriptions
DogEpiMonitor offers free plans with basic features and paid plans through subscription that grant access to extended features: recording more Pets, access to AI assistant consultations, advanced reports, extended clinical history, increased storage capacity, and other exclusive features.
Paid subscriptions automatically renew based on the billing cycle (monthly or annual) unless cancelled by the User. Billing and payment processing are conducted through PayPal, a secure third-party payment processor.
Plan changes (Upgrades / Downgrades): Due to PayPal billing policies, to upgrade or downgrade your active plan, you must first cancel your current active plan (which returns your account status to Freemium immediately) and then purchase the new desired plan. Any remaining prepaid days of the cancelled billing cycle cannot be prorated or refunded by PayPal and will be lost. To avoid losing prepaid days, it is highly recommended to perform plan changes close to your next billing renewal date.
The User may cancel their subscription at any time through their account settings. The cancellation will take effect at the end of the current billing period, retaining access to premium features until that date.
As a general policy, refunds are not provided for billing cycles already invoiced, unless applicable law dictates otherwise or in exceptional cases at the sole discretion of the Owner. Unused features do not generate a right to a refund.
7. Multimedia Content and User Responsibility
The User may upload photos, videos, and documents related to their pets. By uploading multimedia, the User represents and warrants that they have all necessary rights to the content, that it does not violate third-party rights or current laws, and that it does not contain illegal, defamatory, obscene, offensive, or discriminatory material.
The User grants the Owner a limited, non-exclusive, and revocable license to store, process, and display the uploaded content solely for the purpose of providing the service. The Owner does not claim ownership of the User's content.
The Owner reserves the right to establish storage limits for large multimedia files. The textual log (seizure data, medications, clinical events) is guaranteed to persist, but multimedia files (photos and videos) are kept for 6 (six) months from their upload date, after which they are deleted automatically.
Prior to automatic deletion, the Owner will notify the User, offering the option to download their files or extend retention by purchasing the Retention Pack available in the application.
The Owner reserves the right to review, moderate, or delete any content deemed inappropriate, offensive, illegal, or in violation of these Terms and Conditions without prior notice.

The User is solely responsible for the content uploaded and agrees to defend and indemnify the Owner against any third-party claims arising from such content.
8. Merchandising and Shop Products
The application may include a shop where the Owner offers products related to the DogEpiMonitor brand: t-shirts, plush logos, accessories, and other merchandising items. These products are sold directly by the Owner or authorized third parties.
Production, storage, and shipping may be handled by third-party providers. The Owner does not warrant the permanent availability of any specific product and may modify or discontinue the catalog at any time.
Transactions are governed by electronic commerce policies applicable in the Argentine Republic and by the specific conditions informed at the time of purchase.
9. Donations and Social Commitment
The Owner may allocate part of the profits generated to donations for animal shelters, rescue organizations, veterinary foundations, or other institutions related to animal welfare.
The selection of recipients, amounts, and frequency is determined solely by the Owner. The User acknowledges that these donations do not constitute a contractual obligation, that DogEpiMonitor does not operate as a formal charity, and that the commitment to make donations does not generate enforceable rights.
The Owner may report publicly on donations made but is not required to provide detailed individual reports.
10. Future Products and Services
The Owner reserves the right to develop, offer, and market physical products related to pet health monitoring in the future, including hardware devices such as sensor collars, monitoring chips, or any other complementary technological devices.
When these products are offered, they will have their own sales terms, warranties, and privacy policies. These products are not part of the current service, and their eventual development does not constitute a contractual obligation to current Users.
11. Availability and Modifications of the Service
The Service is provided "as is" and "as available". The Owner does not warrant that the application will be available continuously, uninterrupted, or error-free. Temporary interruptions may occur due to technical maintenance, updates, connectivity issues, or other operational circumstances.
The Owner reserves the right to modify, update, improve, or discontinue application features without prior notice and without generating any right to compensation. Likewise, the Owner may establish usage limits, storage restrictions, or other technical limitations deemed necessary.
12. Ownership of Data
The User retains all ownership rights over data, information, content, and any other materials uploaded or stored in the application. DogEpiMonitor stores and processes this information solely to provide the contracted service under the terms established in the Privacy Policy.
The User is solely responsible for the accuracy, truthfulness, legality, and relevance of the uploaded information. The Owner does not verify or validate the entered information and assumes no responsibility for its content or consequences resulting from its use.
13. Prohibited Conduct
It is expressly prohibited to use the application for illegal purposes or contrary to morals and good customs; attempt to breach system security; reverse engineer or decompile the code; interfere with service operation; gain unauthorized access to other Users' data; use unauthorized robots or automated means; and perform any action that could damage the technical infrastructure.
In case of misuse or violation of these Terms, the Owner reserves the right to temporarily or permanently suspend the User's account, cancel access, and take corresponding legal actions.
14. Limitation of Liability
To the maximum extent permitted by current law, the Owner will not be liable for direct, indirect, incidental, or consequential damages arising from the use of the application; medical decisions made by the User; service interruptions; content errors; unauthorized access; information loss caused by technical failures, computer viruses, or third-party attacks; or any circumstance beyond the Owner's direct control.
The User acknowledges and accepts that they use the application at their own risk and responsibility.
15. Intellectual Property
All intellectual property rights over the DogEpiMonitor application, including its design, source code, graphical interface, logos, trademarks, and content, are the exclusive property of the Owner or its licensors and are protected by intellectual property laws in force in the Argentine Republic and applicable international treaties.
The User acknowledges that these Terms do not grant them any rights over the Owner's intellectual property, except for the limited, personal, non-exclusive, non-transferable, and revocable license to use the application.
16. Modifications of the Terms
The Owner reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication. Continued use of the application constitutes express acceptance of the new terms.
17. Termination
The Owner may terminate User access, suspend accounts, and delete information at any time, including for violation of these Terms, improper conduct, or unpaid subscriptions.
The User may terminate their relationship with DogEpiMonitor at any time by deleting their account. Termination does not exempt the User from accrued obligations or subscription fees.
Upon requesting account deletion, all personal data, pet medical records, multimedia files, and messages are deleted immediately and permanently. This action is irreversible and cannot be undone once executed.
18. Applicable Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Argentine Republic. For any disputes, the parties submit to the jurisdiction of the Ordinary Courts with competence in the Autonomous City of Buenos Aires, with express waiver of any other jurisdiction.
